4. Intellectual Property and Trademarks

"EMKTG LAB", its logo, "AI Decision Readiness Assessment™", and other distinctive signs used on the Site constitute trademarks, de facto trademarks, or other distinctive signs belonging to Nicoletta De Vincenzi / EMKTG LAB.

All frameworks, methodologies, prompts, reports, questionnaires, workflows, Assessment-generated content, technical documentation, design elements, user interfaces, and any other materials developed by EMKTG LAB are also reserved, even if not registered as trademarks.

Reproduction, distribution, modification or use of Site content without prior written authorisation is strictly prohibited.

5. Permitted Use and Cybersecurity

You agree to use the Site solely for lawful purposes and in accordance with these Terms. In particular, you must not:

  • Use the Site for fraudulent, illegal or rights-infringing activities
  • Attempt to access restricted areas without authorisation
  • Transmit viruses, malware or any harmful code
  • Conduct automated scraping of Site content without written authorisation
  • Perform activities that may compromise the security, integrity, availability, or proper functioning of the Site, including unauthorised penetration testing, reverse engineering, automated scanning, or attempts to bypass implemented security measures.

6. AI and Scraping

It is forbidden to use the Site, its contents, or the outputs generated by the services to train, improve, or evaluate artificial intelligence models, machine learning systems, or datasets without prior written authorisation from EMKTG LAB.

7. AI Decision Readiness Assessment™

The AI Decision Readiness Assessment™ is a proprietary diagnostic tool of EMKTG LAB. Results are indicative in nature and do not constitute binding legal, financial or technical advice. The Assessment does not constitute a certification, a regulatory compliance evaluation, nor a guarantee regarding the organisation's maturity level.

EMKTG LAB is not liable for business decisions made solely on the basis of Assessment results.

The processing of personal data is governed by the Privacy and Cookie Policy available on the Site.

8. Disclaimer and Limitation of Liability

Site content is provided for informational purposes. EMKTG LAB endeavours to keep information accurate and up to date, but does not warrant the completeness, accuracy or fitness of the content for any particular purpose.

To the extent permitted by applicable law, EMKTG LAB excludes all liability for any loss of profits, loss of data, business interruption, loss of earnings, or other indirect, consequential, or incidental damages arising from the use of the Site.

EMKTG LAB is also not liable for:

11. Booking Consulting Sessions

Booking a Discovery Session through the Site is subject to confirmation by EMKTG LAB. A booking does not constitute a service contract. Specific terms of engagement will be defined in a separate agreement.

12. Newsletter

Newsletter subscription is voluntary. You may unsubscribe at any time via the link in any email or by writing to info@emktglab.com. For details on data processing, please refer to the Privacy and Cookie Policy.

13. Changes to Terms

EMKTG LAB reserves the right to modify these Terms of Use at any time. Changes will be published on this page with an updated date. Continued use of the Site after publication of changes constitutes acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms of Use are governed by Italian law. Any dispute relating to the use of the Site shall be subject to the exclusive jurisdiction of the Courts of Rome, unless otherwise required by applicable consumer protection law.
